For internet purchases, the competitor must have the item in stock on their website. If no shipping and handling charges are readily available in the advertisement, our friendly and helpful staff can help you determine these costs.

An identical item is a product with the same manufacturer and model number. An Authorized Canadian dealer is a retailer that the Canadian manufacturer willingly sells to (typically, unauthorized dealers do not offer legal Canadian warranties and/or packaging). The price match guarantee does not apply to refurbished items or demos.

An advertisement is defined as a copy of a current Canadian: dated advertisement, catalogue page or competitor web page.

Every package leaving by Blackfoot Direct is carefully packaged by us before shipping.

All Canadian orders will be shipped from our Canadian warehouse using one of the following shippers:

Our Free Shipping offer is for orders over $500 (before tax) shipped anywhere in Canada. Items will be shipped via ground shipping. Orders under $500 will be charged a flat rate of $20 for anywhere in Canada. Shipping times for Canada vary, but generally range between 2 and 5 business days. Larger products, such as wheels, tires and body work, will be shipped in its original packaging and subject to additional shipping charges.

All products and orders are FOB (free on board) from our warehouse in Calgary, AB, Canada. For expedited orders, be sure to place your order before 12PM any regular business day. Weekend delivery is not available. We do not process or ship orders on weekends or holidays.

RETURN POLICY

Of course, we want you to be the final judge of satisfaction. We take great pride in our reputation for quality and excellent value. When you receive products from Blackfoot Direct if you're not satisfied with your purchase, we'll replace it or give you your money back. It's that simple.

Refunds for items returned within 30 days of the purchase date will be credited in the same form as the original payment type. Unfortunately you cannot return merchandise purchased through Blackfoot Direct at Blackfoot Motorcycle Ltd's (Blackfoot Motosports) Calgary Retail location.

All products returned to us must be accompanied by a valid Return Merchandise Authorization (RMA) number issued by Blackfoot Direct within 30 days of your original invoice date, for most retail merchandise. After 30 days from purchase we can no longer issue an RMA and will refer you to the manufacturer for warranty service. RMAs expire in 15 days after they are issued. You may request a RMA by calling our toll free number 1-877-214-2801. All returned products must be 100% complete in original packaging and in resalable condition, with all packaging, manuals, blank warranty cards and other accessories and documentation included. Due to the volatile nature of product prices, items will only be refunded at the current pricing at the time of return.

A valid RMA number must be written clearly on the outside of the packaging. Incomplete or unauthorized returns will be refused. The customer is responsible for any additional damage to an item or loss during shipment to Blackfoot Direct. Therefore, we recommend that all items shipped to us be insured for damage or loss.

RETURNS OTHER SHIPPING AND HANDLING INFO
Shipping and handling charges are not refundable. We will happily refund the return shipping cost if the return is a result of our error. A credit will be issued as soon as we receive and process your return. Please allow up to two billing cycles for a refund to appear on your credit card statement. Special offers may be subject to reduction by a return/exchange or cancellation.

You may not assign this agreement without Blackfoot Direct 's prior written consent. Blackfoot Direct is the intended beneficiaries of this agreement. If there is any inconsistency between this agreement and other agreement included with or relating to products purchased from Blackfoot Direct, this agreement shall take precedence.

INTERPRETATION
These terms and conditions shall be interpreted under and governed by the federal laws of Canada, without giving effect to conflicts of law rules. Headings used in these Terms and Conditions are for convenience of reference only and are not intended to be part of, or to affect the meaning or interpretation of, these Terms and Conditions.

NO MODIFICATION
Any additional or altered terms attached or adhering to an order shall be null and void and without effect, unless agreed to in writing by Blackfoot Direct. These terms and conditions may not be modified, altered or amended without the written agreement of Blackfoot Direct.

SEVERABILITY
If any provision of these terms and conditions is held to be illegal, invalid or un-enforceable, in whole or in part, the legality, validity and enforceability of the remaining provisions shall not be affected or impaired. The terms and conditions stated herein are declared to be Severable.

TERMS AND CONDITIONS OF SALE
The following terms and conditions govern the sale of products by Blackfoot Direct Ltd. By submitting your on-line order to Blackfoot Direct, you have indicated your acceptance to be bound by these terms and conditions of sale. At Blackfoot Direct ‘s sole discretion, these terms and conditions may be changed without prior notice at any time before At Blackfoot Direct accepts your order.

PAYMENT TERMS
Payment is due by Visa, Mastercard, Certified Cheque, Money Order or Bank Draft. Once an order is placed by credit card, the credit card account will be verified at the time the order is placed. Should a credit card is declined, so will be the order. No C.O.D. orders are accepted. Orders are processed ONLY upon receipt of payment.

PRICES
Prices shown on the Blackfoot Direct 's site do not include shipping and handling. Neither do the prices include taxes unless otherwise noted. All prices are in Canadian dollars. The price charged for an order will be the price in effect at the time the order is made. Nonetheless, if the price drops before shipment and you notify Blackfoot Direct of the lower price before the product is shipped, in which case (and in that case only) the price charged will be the lower price.

PAYMENTS
Upon processing of an order, Blackfoot Direct will charge the total amount of the order to the chosen method of payment. In stock items will be shipped immediately. Backordered items will ship as they become available at the expense of Blackfoot Direct. Credits or refunds will be issued for unavailable items and overdue backordered items as soon as requested or determined that an item is not available.

Blackfoot Direct does NOT charge any credit card or payment surcharges. We gladly accept the following payment methods:

SALES TAXES
Goods and Services Tax (GST) will be charged for all orders shipped to a Canadian address, except for Harmonized Sales Tax (HST) which will be charged to residents of New Brunswick, Prince Edward Island, Nova Scotia and Newfoundland. For US bound orders, no additional taxes or duties will be charged but are solely the responsibility of the purchaser.

DISCLAIMER OF WARRANTY
When products are shipped to you, their limited warranties applicable to products are in effect and are included with the shipment. Certain products may have additional warranties provided by the original manufacturer but not by Blackfoot Direct. On our web site, "as is" products may not have warranties from Blackfoot Direct (other than those warranties implied by and incapable of exclusion, restriction or modification under applicable law), but may still hold warranties from the manufacturer.

LIMITED WARRANTY
Blackfoot Direct 's liability shall as limited to repairing or replacing, at its option, any defective product which is returned, freight prepaid to Blackfoot Direct, according to the Merchandise Return Procedure set forth in Section Merchandise Return Procedure below. Buyer shall bear all responsibility for shipping charges and risk of loss or damage during transit to Blackfoot Direct. Products which have been subjected to abuse, misuse, alteration, neglect or unauthorized repair or installation, as determined solely by Blackfoot Direct, are not covered by warranty. Any alterations, addition, improvements or attachments to the product(s) not authorized in writing by the Blackfoot Direct shall be deemed to be a waiver of the warranty by Buyer and shall render the warranty null and void. Blackfoot Direct shall return repaired or replaced product(s) to Buyer, at its expense via regular ground service within Canada. Shipping charges by all other methods and to all other destinations shall be borne by Buyer. Blackfoot Direct MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL Blackfoot Direct BE LIABLE FOR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES SUCH AS LOSS OF PROFITS OR OPPORTUNITIES, AND IN NO EVENT SHALL Blackfoot Direct 's LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT(S).

LIMITATION OF LIABILITY
The maximum liability to you for products purchased from Blackfoot Direct shall be limited to the purchase price you have paid for the products. Also, Blackfoot Direct will not be liable for any property damage, personal injury, loss of use, loss of profits, or other consequential, indirect, incidental, punitive or special damages. This applies to all situations however caused, whether for breach of warranty, contract, tort (including negligence), strict liability or otherwise, other than those damages that are incapable of limitation, exclusion or restriction under applicable law.
